Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Nibbl mobile application ("the App") or website at nibbl-app.co ("the Website"), operated by Nibbl ("we", "us", or "our"). By accessing or using the App or Website, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 13 years old to use Nibbl. By creating an account, you confirm that you are at least 13 years of age. If you are under 18, you confirm that you have obtained your parent or guardian's permission to use the App. We reserve the right to terminate accounts where we believe a user does not meet these requirements.

2. Your Account

To use Nibbl, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate and up-to-date account information.
Notify us immediately of any unauthorised use of your account.
Not share your account credentials with any other person.
Not create more than one account per person.

We reserve the right to suspend or delete accounts that violate these Terms or that have been inactive for an extended period.

3. Acceptable Use

You agree to use Nibbl only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

Use the App to transmit any unlawful, harmful, or offensive content.
Attempt to gain unauthorised access to any part of the App or its servers.
Reverse engineer, decompile, or disassemble any part of the App.
Use automated tools (bots, scrapers, crawlers) to access or collect data from the App.
Misuse the group invite code system to gain access to other users' groups without permission.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4. Subscription and Payments

Nibbl offers a free tier and a premium subscription ("Nibbl Premium"). Premium subscriptions are available on a monthly, quarterly, or annual basis. By subscribing, you agree to the following:

Billing — subscription fees are billed through your Apple ID or Google Play account at the start of each billing period. All prices are displayed before purchase.
Auto-renewal — subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Cancellation — you may cancel at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partially used subscription periods.
Price changes — we reserve the right to change subscription pricing. We will provide reasonable notice of any price change before it takes effect.
Free tier limits — the free tier includes a limited number of daily swipes and other restrictions as described in the App. These limits may change over time.

All payment processing is handled by Apple App Store or Google Play. We do not store your payment card details.

5. Group Features

Nibbl's group swiping feature allows you to create or join groups with other users using a shared invite code. By using group features, you acknowledge that:

Other group members can see the name of venues your group has matched on.
Individual swipe decisions (like or dislike per venue) remain private to each user.
The group owner can update preferences and reset the group's venue list at any time.
You are responsible for sharing invite codes only with people you trust.

6. Third-Party Services

Nibbl uses third-party services including the Google Places API to provide restaurant and venue data. Restaurant information — including names, ratings, opening hours, and images — is sourced from Google and may not always be accurate or up to date. We are not responsible for the accuracy of third-party data or for your experiences at any venue discovered through the App.

7. Intellectual Property

All content, design, trademarks, logos, and software included in the Nibbl App and Website are the property of Nibbl or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our express written permission.

8. Disclaimers

Nibbl is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

The App will be uninterrupted, error-free, or secure at all times.
Restaurant data, ratings, opening hours, or prices obtained through the App are accurate.
The App will meet your specific requirements.

We are not liable for any decisions you make based on information provided by the App, including decisions about where to eat.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Nibbl shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may delete your account at any time via the Settings screen in the App. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including sections on intellectual property, disclaimers, and limitation of liability.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We will notify you of material changes via the App or by email.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
